Saturday Night, His girl friend beside him, Christian Reyes is taking flowers to a relative’s daughter’s baptismal celebration.

 

Then it happens, flashing lights, taillight isn’t working, handcuffs, a crying hysterical girl friend must now run to the planned celebration to tell Christians mother, younger brother and little sister that the police have taken Christian away.

 

They can’t contact him. Sunday goes by, friends are trying to help. A lawyer is called. They don’t have an A# so they can’t track him. They wait. Sunday goes by, no word. Monday afternoon they get a call, expect a call on Tuesday afternoon. No word Tuesday.

 

Wednesday afternoon Christian’s girlfriend gets a text. “I signed the paper. They said if I didn’t they would hold me for two months in Tacoma and then I would be deported anyway.”

 

They go to the jail. He isn’t there. Where is he? Are they taking him the 700 plus miles to the detention center in Tacoma WA. Are they sending him to Mexico without word or even a goodbye? Stroke of luck, someone found him listed as being held in a neighboring county’s jail. What does it mean? What are they doing? When can we talk to him? Can’t sleep. Can’t eat. Can’t think. The world around them crumbles.

This is the scene, repeated over and over hundreds of times a day, every day.
 



 

On June 17th 2011 John Morton Director of ICE put forth a memo giving guidelines for the use of prosecutorial discretion. On August 18th 2011 Janet Nepolitano sent a letter to Senator Dick Durbin confirming the intent of DHS and ICE to follow the June 17th memo and review the 300,000 cases clogging the system and making the priority cases those that were criminals and not low priority undocumented individuals. To date local and field officers of ICE have thumbed their nose with comments like “We are completely unhappy,” Chris Crane said recently.



 

The head of the union that represents the country’s immigration enforcement officers, Crane has recently been on a crusade to undermine the intent of the June 17th 2011 John Morton Memo, and the administration. Ice has shown callous disregard and has instead tried to speed up the timeline to deportation by bullying and intimidating those picked up with no criminal record and whom they know would qualify for prosecutorial discretion into signing voluntary deportation papers.

 

This is wrong. It is time to show support for even small steps taken to try to give relief to hard working immigrants until such time as a do nothing Congress and a deadlocked Senate have the courage to take on and fix a broken and destructive immigration policy. I for one call on the Union head and it’s members to stand down and stop the insubordination.

 

Thank you Richard Hartwell from Action Dream Team for your fine article!  While the Obama White House may think it is in charge, the Department of Homeland Security has other thoughts.  They show little effort in following the directive written by the commander in chief.  Instead, they act of their own accord, ignoring directives from superiors, interested only in numbers and egos, with a heartless disregard for the lives they are tearing up.

When a security agency begins to take the rules and laws it wants and ignore the ones it does not want, the agency has become rogoue and out-of-touch with the citizens it serves.  Super agencies like this which are answerable to no-one, can have their way even if their commander and chief says it isn’t supposed to be that way.  Too bad.

 

Comprehensive Immigration Reform (CIR) will solve many problems.  Included within CIR is the Dream Act which would allow young people to go to school or go to the military.  When we roll up our sleeves we can solve our problems.  When our government refuses to listen to superiors, it is time to give those who refuse to listen a permanent vacation!

One thing we never have to worry about is me becoming a professional singer!

 Here is a message from the heart.

 The rest might best be left to the imagination!

 

If you are missing someone you love, don’t lose hope.  Many people are dedicated to reforming the laws which part so many people.  As advocates, we love our country.  We admire the strength and the leadership of those who have come to make it a better country.   We wish the law enforcement charged with dividing us the very best, for they have a difficult role to play.  Still, we believe we must keep working to improve our country and the great people who live within her.  Together we can solve any problem.  Apart we are lost under the rainbow of hope and dreams.

 

 




Please watch for news about many projects that are underway throughout the country.  Soon, Dreamer, a True American Story will be a reality at a theater near you!  Jesse said he just finished shooting his trailer and he soon will be cutting and getting it ready.  He says he wants to thank all of you who have made his dream come true.

Children Lost Father at Strawberry Days Festival

 

Father’s Day Weekend, 2011

 

 

The date is Father’s Day weekend, 2011.  Children are having a blast at the Strawberry Day’s Festival in Glenwood Springs, Colorado, near Aspen.   Mother’s are cherishing the time dad has to spend with the family.  It is a celebration that will leave lasting memories of joy, and sadness, in the hearts of multiple families.

While the children of two families are jumping up and down in the bouncy castle, they do not spot strangers approaching their dads.  Soon, though, terror runs through the family.  The fathers are lured away.  The children are left on the ride to fend for themselves.

 

 

The mothers become frantic.  The dads were gone and so were the kids!  Where did everyone go?  Then the festive mood of the fair was broken as police chased a man through the crowd.  He was finally tackled, in front of astonished little ones and mothers and fathers.  What was going on in the sleepy town of Glenwood Springs near Aspen, Colorado?

 

 



Although the term ICE raid may be a slightly over-stated, and it may not, it turns out families were not the only ones who came to the 113 year old Strawberry Day’s festival to meet people in the community and have a good time.   Unbeknown to those at the event, agents from Immigration and Customs Enforcement (ICE) had set up a command post.  Using local sheriff’s officers to lure unsuspecting “prospects” ICE began checking ID’s.  It didn’t take much to identify the Hispanics in the crowd

 

 

ICE says it was the other way around.  The Garfield County Sheriff’s Office invited ICE to the carnival to have fun on the rides and as part of an area-wide gang sweep.  However, neither agency has been able to explain why the “area-wide” gang sweep netted so few “gang members”, a total of three arrests, when prior gang sweeps netted multiple arrests.  Nor was either law enforcement agency able to explain why Colorado gang members are so well behaved.  The people ICE arrested had almost no criminal histories.

 

 

Maybe the truth lies between the two stories.  Maybe ICE drove their RV-Bus style command post to the fair to have a good time.  Imagine over-sized ICE officers who are used to lots of excitement getting bored spinning on the merry-go-round.  Or maybe officer’s from the sheriff’s department got dizzy while twirling on the Ferris wheel.  ICE took both fathers who had been watching their children shriek with joy and laughter while on the bouncy castle ride.  We only hope they could not hear the shrieks of their children as they sat in ICE custody.  One father was released, but the family of the second person would lose dad on father’s day weekend.

 

 

The fair quickly emptied out and few of the Anglo or Hispanic families returned.  No one wants to take their children to places where grown men carrying guns act like clowns.  It must have been a big financial bust to the community which supported the event.  But why should ICE care?  The tax payers footed the bill for the RV-Bus-like ICE command post.  The reputation of the festival and the community was tainted.  Neither law enforcement agency took responsibility for conducting an immigration enforcement action at an event frequented by US citizen toddlers and pregnant moms.  While citizens can take action against the Garfield County Sheriff’s Office, they can choose to not re-elect the Sheriff who places families at risk, ICE remains out of touch with the people they are sworn to protect.

A member of the Latino community who heard about this raid sent us this poem.  He was moved by the prospect of losing a dad on Father’s Day weekend after we reported this weeks ago.  He was intrigued with whether the mother must go into action or remain frozen in fear.  Hang on to your seats!  I would rather listen to this caliber of performance any day than watch law enforcement chase poor people through carnival crowds.

Rights For All People (RAP) has been very busy lately.  They are working on several events and campaigns, including an action against Wells Fargo, whose subsidiary, Wells Fargo Financial Services is one of the largest owners of GEO Group, a private company which invests in private prisons, including immigration prisons.  RAP is also working on a fun campaign, “That Law Is Jacked“.  The civil rights organization has been a strong supporter of Gerardo Noriega, a Dream Student in deportation proceedings, as well as hosting leadership workshops to empower the community.

Students of undocumented immigrants have a new lease on life after the Secretary of Homeland Security, Janet Napolitano, issued a letter indicating the Obama Administration has used it’s executive authority to change the way some classes of deportation cases will be handled, including those who qualify for the proposed Dream Act currently in front of Congress.

Currently, immigrants can ask federal prosecutors in charge of deportation cases to use their discretion in the prosecution of the case.   Where the prosecutor uses his discretion, the immigrant is not deported.  In order to qualify, an immigrant in removal proceedings must show he is not a risk to the security interests of the US and where hardships exist.  The term discretion is appropriate because only some prosecutors have elected to refrain from insisting upon the removal of the individual.  Each case is carefully reviewed and no exact standard exists for granting of relief.

Today, the Department of Homeland Security (DHS) says it will develop new criteria to identify deportation cases that likely qualify for prosecutorial discretion.  The Department will use “positive factors” in determining who will qualify for prosecutorial discretion and who will not.  Those factors will include how long the person has been present in the US,  whether the immigrant is a child, an elderly person, a veteran and those with serious health problems or disabilities.

While the Napolitano letter will help students who were brought here as children, hence should not suffer the consequence of deportation, it does not necessarily provide legal status for the individual who is granted relief from deportation.  Work documents and driver’s licenses will may still be difficult to obtain.

Anti-immigration opponents insist the Obama Administration has granted “amnesty” to the undocumented youth and other low-priority deportation cases.

Comprehensive Immigration Reform (CIR) remains a priority for the nation if it is to resolve the matter of 12 million undocumented immigrants.  Behind each immigrant is another four to five US citizen family members.  Behind the approximate 60 million undocumented immigrants and US citizen family members is the faith and credibility of a nation which claims to be based upon notions of equality and justice for all, a nation made by and maintained by immigrants.

A variety of organizations stood up against ICE abuse with it’s system of private prisons.  The AFSC helped organize the event in which a large group of people met at the GEO facility in Aurora Colorado.

The group made up of multiple races, citizens and permanent residents, and families grieving the incarceration of their loved ones in prisons for profit.

Approximately 100 people gathered at the GEO center in North Aurora, Colorado.  They say they are shocked at the new walls and the increase in the size of the facility.  ICE is clearly planning on taking care of many new invitees.  At $130 per day, GEO group is making a pretty penny keeping people locked up for a buck.  The use of the private prisons allows ICE to hide the true cost of imprisoning 450,000 immigrants last year, a large percentage of whom have never committed a crime.

The AFSC and friends hold the vigil on the first Monday of every month.  If you are in the Metro area, please come by and meet the people who say no to private prisons, GEO group and prisons for profit, ICE raids and imprisoning children and housewives who would otherwise make productive, tax paying, American citizens.

Comprehensive Immigration Reform (CIR) will strengthen the border, add legions of border patrol agents, and fund security for our nation’s sea ports.  At the same time, it would bring 12 million undocumented immigrants out into the sunshine.  The law would give them a long journey to become permanent residents of the US, so long as they pass a background check, pay fines which when totaled would add billions to the federal treasury, and pay back taxes.

The Dream Act will allow the youth of undocumented students a chance to go to college or serve in the military.  After background checks and fines which will add additional billions to help tax payer causes, Dream Students could become permanent residents.   They, too, will have a 7 to 10 year path, and have to tow the line pending completion of their end of the bargain.

Neither option is amnesty because both bills require substantial sacrifices on the part of the immigrants in order to take advantage of the benefits of the law.  A conservative legislature has blocked both the Dream Act and CIR, while asking citizens to endure continuing reductions in Medicare, social security, schools and police protection.
