Students of undocumented immigrants have a new lease on life after the Secretary of Homeland Security, Janet Napolitano, issued a letter indicating the Obama Administration has used it’s executive authority to change the way some classes of deportation cases will be handled, including those who qualify for the proposed Dream Act currently in front of Congress.

Currently, immigrants can ask federal prosecutors in charge of deportation cases to use their discretion in the prosecution of the case.   Where the prosecutor uses his discretion, the immigrant is not deported.  In order to qualify, an immigrant in removal proceedings must show he is not a risk to the security interests of the US and where hardships exist.  The term discretion is appropriate because only some prosecutors have elected to refrain from insisting upon the removal of the individual.  Each case is carefully reviewed and no exact standard exists for granting of relief.

Today, the Department of Homeland Security (DHS) says it will develop new criteria to identify deportation cases that likely qualify for prosecutorial discretion.  The Department will use “positive factors” in determining who will qualify for prosecutorial discretion and who will not.  Those factors will include how long the person has been present in the US,  whether the immigrant is a child, an elderly person, a veteran and those with serious health problems or disabilities.

While the Napolitano letter will help students who were brought here as children, hence should not suffer the consequence of deportation, it does not necessarily provide legal status for the individual who is granted relief from deportation.  Work documents and driver’s licenses will may still be difficult to obtain.

Anti-immigration opponents insist the Obama Administration has granted “amnesty” to the undocumented youth and other low-priority deportation cases.

Comprehensive Immigration Reform (CIR) remains a priority for the nation if it is to resolve the matter of 12 million undocumented immigrants.  Behind each immigrant is another four to five US citizen family members.  Behind the approximate 60 million undocumented immigrants and US citizen family members is the faith and credibility of a nation which claims to be based upon notions of equality and justice for all, a nation made by and maintained by immigrants.
